Tears of the Phoenix Publishing Agreement

By submitting your work (fiction or art) to Tears of the Phoenix, you agree to the terms and statements below:

PUBLISHING RIGHTS

You agree to grant Tears of the Phoenix one-time, exclusive publishing rights to the work(s) in the publication you have specified upon submission.

If your work is accepted, you agree not to publish said work(s) in any other print, digital or other form of media until six months after publication date for Tears of the Phoenix Anthologies or three months for Tears of the Phoenix Ink. After which time, all publication rights revert back to you.

COPYRIGHT

By submitting your work, you are stating that it has been created by you and that you are the sole and exclusive owner of the rights to work.

By submitting, you certify that no part of your work is plagiarized from any other source, and does not libel or slander any other party.

The creator retains the copyright to his/her work at all times.


INDEMNIFICATION

The author or artist shall be responsible for any lawsuits or damages resulting from his/her infringement upon the rights of other authors, organizations, institutions, copyright holders, or others, as a result of plagiarism, libel, slander, or any other misuse of any material included in their work. 

The author or artist shall indemnify Tears of the Phoenix for all damages, costs and expenses, including attorneys' fees, incurred by Tears of the Phoenix as a result of said infringement.

DEVELOPMENT OF THE WORK

By submitting, you agree that the editors of Tears of the Phoenix are permitted to edit and proof the content so that grammar, format, capitalization, punctuation, and spelling of submissions conform to Tears of the Phoenix's style. Any content issue related to plot or story development will be discussed directly with the author and no changes regarding such will be made without the author's approval.

PROMOTIONAL PARTICIPATION

By submitting, you agree to allow Tears of the Phoenix the right to use your name in promotion and publicity material related to the publication containing your work.

ROYALTIES

By submitting, you recognizes that this project is a not-for-profit charity venture, and as such, agree that all royalties from said publication will be donated in full to the agreed-upon non-profit literary charity.
